Title: The Impact of Non_Mutual Collateral Estoppel on Tort Litigation Involving Several Liability
Author: Occhialino, Mario
Abstract: This article focuses on the extent to which the percentages of fault attributed to wrongdoers in one case may be binding in subsequent litigation involving the same incident and some of the same persons who were parties in the earlier case. Also considered is the issue of whether the factfinder's determination of the amount of damages suffered by a party is binding upon parties in succeeding lawsuits involving the same injuries.
